Judge dismisses wrongful-death claim in Utah standoff suit

A federal judge has dismissed a wrongful-death claim in a lawsuit filed by the family of a man who was killed by a police SWAT team during a standoff in northern Utah.

The Standard-Examiner reports Judge David Nuffer dismissed the claim earlier this month, but allowed the lawsuit to continue on its other claims, which include allegations of illegal search and seizure and deprivation of constitutional rights.

The suit was filed in 2016 on behalf of 35-year-old Jose Calzada, who was shot by police after they entered his Roy home in 2014. The suit names the city of Roy, Weber County and members of the SWAT team as defendants.

A review by the Weber County Attorney’s Office ruled the shooting was justified.
